The Delhi High Court has announced that the Aditya Birla group’s apparel brand name ‘Peter England’ is a recognised mark due to its extensive promotions and retail presence in India.
“Considering the widespread promotional and advertising activities undertaken by the plaintiff, it is apparent that the trademark ‘Peter England’ has become the single source identifier of the plaintiff and its goods and services,” said justice Mini Pushkarna in an order at the court, the Press Trust of India reported. “This court also notes the fact that the plaintiff has the sole and exclusive rights in and over the trademark ‘Peter England.'”
Aditya Birla Fashion has moved the Delhi High Court to restrict the use of the mark and brand name ‘Peter England’ and stop the defendants from using it in their businesses. The business argued that such use constitutes a copyright infringement and is also an infringement of Peter England’s artistic work and trademark, ET Bureau reported.
Peter England’s brand history dates back to 1889 in Ireland where the menswear brand was originally established. Today, the label is based in India after its acquisition by Aditya Birla Fashion in the year 2000. Peter England retails from over 1,000 stores across India and specialises in suits and smart casual attire, according to Aditya Birla Group’s website.
