Gaurav Gupta files cases against nine alleged counterfeiters at Delhi High Court

Couturier Gaurav Gupta has filed a number of cases at the Delhi High Court against alleged counterfeiters and is seeking damages and restraining orders. These cases could set a precedent for the fashion industry and beyond.

“Counterfeiters copied our signature sculpting techniques, misleading customers into thinking they were purchasing our designs,” eponymous designer Gaurav Gupta told the Economic Times. Gupta is known for his 3D sculpted gowns which have been worn by global celebrities including Cardi B and Beyonce among others.
 
The New Delhi based designer has so far filed nine separate cases against alleged counterfeiters, based across New Delhi, Mumbai, and Punjab, at the Delhi High Court. Gupta has claimed Rs 2 crore in damages from each case and aims to obtain restraining orders against all nine defendants.
 
The Delhi High Court ruled to acknowledge the intellectual property rights of Gaurav Gupta Couture’s holding company Reflect Sculpt Private Limited, ET Bureau reported. Each defendant has been forbidden from manufacturing counterfeit clothing and has been ordered to destroy all counterfeit products which have already been made while also removing all online content relating to them.
 
Gaurav Gupta has worked with a team of between two to three investigators and four to five advocates for each of its counterfeit cases. The business discovered many of the counterfeit products by searching markets and on social media. The results of the court cases could lead other brands to follow suit, thus tightening the net on counterfeit luxury goods.
