Diamond trader Mehul Choksi, accused of fraud by the Punjab National Bank among others and wanted for extradition to India, has notified a court in Mumbai that he is currently located in Belgium, undergoing medical treatment for cancer.

Choksi’s legal counsel Vijay Aggarwal petitioned a court in Mumbai on February 11 that the accused should not be declared a fugitive economic offender as Indian probe agencies are aiming to do, ET Bureau reported. Aggarwal argued that, by informing the court of Choksi’s whereabouts in Belgium instead of hiding it, he cannot be declared a fugitive economic offender. Aggarwal also told the court that Choksi is unable to travel because of his health.

Prior to the hearing, Choksi’s whereabouts was not commonly known. His last known location was Antigua, where he took citizenship after leaving India following the announcement of the alleged fraud.

“My client has faced mental agony and physical pain when he was being abducted by the sleuths who wanted him to bring to India,” said Aggarwal, the Economic Times reported. “Post that, he has been diagnosed with cancer and has been undergoing treatment in Belgium.”

Choksi was the promoter for diamond jewellery business Gitanjali Gems and has been accused of playing a key part in one of the largest scale frauds in India’s banking history along with his nephew and fellow diamantaire Nirav Modi. Modi is being held in Wandsworth Prison in the UK and is years into a process of extradition hearings and appeals as Indian authorities attempt to bring him to India to stand trial. Both Modi and Choksi maintain their innocence in the case.
